§ 1. GENERAL PROVISIONS

1.3. Scope of the Terms

1. These Terms and Conditions define the rules for using the Hansa Wear online store and concluding sales agreements.
2. The Terms are available free of charge at: www.hansawear.com/terms-and-conditions
3. Before placing an order, the Customer is required to read and accept these Terms.

§ 2. DEFINITIONS

Store – the Hansa Wear online store operating on the Shopify platform at www.hansawear.com, run by MAMY TO Łukasz Chomyn.

Customer – a natural person, legal person, or organisational unit without legal personality who makes purchases in the Store.

Consumer – a natural person performing a legal act not directly related to their business or professional activity.

Sales Agreement – a distance sales agreement for products concluded between the Seller and the Customer via the Store.

Product – a movable item available in the Store that is the subject of the Sales Agreement.

Order – a declaration of intent by the Customer aimed at concluding a Sales Agreement.

§ 3. CONDITIONS OF USE OF THE STORE

3.1. Technical Requirements

To use the Store, you need:

• A device with internet access
• A web browser supporting JavaScript and cookies
• An active e-mail address

3.2. Prohibited Conduct

It is forbidden to:

• Provide unlawful content
• Use the Store in a manner that violates applicable law or good practices
• Take any action that may disrupt the proper functioning of the Store

§ 4. PLACING ORDERS

4.1. Order Process

1. An order is placed by adding Products to the cart and completing the order form.
2. The Customer selects the payment and delivery method.
3. Before finalising, the Customer accepts the Terms and Privacy Policy.
4. The Customer confirms the order by clicking "Order and Pay" or an equivalent button.

4.2. Order Confirmation

1. After placing an order, the Customer receives an automatic confirmation to the provided e-mail address.
2. The Sales Agreement is concluded upon receipt of the confirmation.

4.3. Accuracy of Data

1. The Customer is required to provide accurate and up-to-date data.
2. The Store is not liable for problems arising from the Customer providing incorrect data.
3. In case of doubt, the Store may contact the Customer to verify the data.

4.4. Product Availability

1. If an ordered Product is unavailable, the Store will notify the Customer immediately.
2. The Customer may:
   • Cancel the order and receive a refund
   • Choose a substitute product
   • Wait for the product to become available again (if possible)

§ 5. PRICES AND CURRENCY

5.1. Price Presentation

1. All prices in the Store are gross prices (VAT included).
2. Prices are displayed in various currencies according to the Customer's selected location.
3. Shipping costs are displayed before order finalisation and are not included in the Product price.

5.2. Currency Conversion

Currency conversion is performed automatically by the Shopify system using current exchange rates. The Customer accepts the rate applicable at the time of placing the order.

5.3. Promotions

1. The Store may run promotional campaigns.
2. Promotions cannot be combined unless the promotion terms state otherwise.
3. Price changes do not apply to orders already placed.

5.4. Gift Cards

The Store offers gift cards of various denominations. Detailed information about gift cards is contained in the Payment Policy.

§ 6. PAYMENT

Detailed information about payments is contained in a separate Payment Policy.

§ 7. DELIVERY

Detailed information about shipping and delivery is contained in a separate Shipping and Delivery Policy.

§ 8. RIGHT OF WITHDRAWAL

Detailed information about withdrawal from the agreement is contained in a separate Returns and Complaints Policy.

§ 9. QUALITY COMPLAINTS

Detailed information about complaints is contained in a separate Returns and Complaints Policy.

§ 10. PERSONAL DATA AND PRIVACY

1. The data controller is MAMY TO Łukasz Chomyn.
2. Detailed information about the processing of personal data is contained in the Privacy Policy.
3. Detailed information about cookies is contained in the Cookie Policy.

§ 11. OUT-OF-COURT DISPUTE RESOLUTION

Information about out-of-court complaint resolution and redress mechanisms is contained in the document Dispute Resolution (ODR/ADR).

§ 12. INTELLECTUAL PROPERTY

1. All content published in the Store (photos, descriptions, graphics, logos) is protected by copyright.
2. Copying, modifying, or distributing content without the Seller's consent is prohibited.

§ 13. FINAL PROVISIONS

13.1. Amendments to the Terms

1. The Store reserves the right to amend these Terms.
2. Amendments do not apply to orders placed before the effective date of the changes.
3. Customers will be informed of any changes via a notice in the Store.

13.2. Governing Law

1. The law governing agreements concluded with the Store is Polish law.
2. For Consumers, the mandatory provisions of the country of their habitual residence also apply, if more favourable.

13.3. Dispute Resolution

1. Any disputes shall be resolved by the competent Polish courts.
2. Consumers may use out-of-court complaint resolution methods (see: Dispute Resolution).

13.4. Provisions for Business Customers

Where the Customer is not a Consumer:

1. The Seller's liability under the statutory warranty for defects (rękojmia) is excluded.
2. The Seller does not have the right to withdraw from the agreement within 14 days.
3. The competent court for resolving disputes is the court with jurisdiction over the Seller's registered seat.
